The primary objective of this assignment was to develop a well-structured bankable PPP project to be the basis for tendering the project for PPP using the Philippine Build-Operate-Transfer (BOT) Law and its Implementing Rules and Regulations (IRRs) as the legal framework. This was the first cold chain project to be implemented in the Philippines under the BOT Law and its IRR and was a pilot project for the establishment of cold chain systems.

Osana provided PPP Legal and Regulatory technical advisory services to improve the legal and regulatory framework for PPP, including the drafting of a comprehensive manual, capacity building, and institutional strengthening. This included performing an analysis of local government legal and regulatory framework, providing legal and regulatory inputs for position papers pertaining to furthering the PPP agenda, as well as providing legal and regulatory inputs to the PPP Manual for National Government Agencies and the PPP Manual for Local Government Units in the Philippines. Osana also supported the government to draft regulations and other associated legal requirements for the establishment of a dedicated infrastructure financing facility, and a mechanism for guarantees against risks. This involved facilitating capacity building of a PPP Center for government officials and agencies to assess potential PPP projects from a legal perspective, and to assess competitive tendering and approval of PPP projects.
